Welcome to Homi, LLC. ("Homi," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Homi mobile application (the "App") and related services, including but not limited to our roommate matching service, housing marketplace, and third-party realtor facilitation (collectively, the "Services"). By accessing or using our App and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App or Services.
1. Eligibility
You must be at least 18 years old to create an account and use the Homi App and Services. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Homi is intended for individuals seeking housing and/or roommates. By using the App, you agree that you are using the Services for personal use only and not for any commercial purposes, unless explicitly authorized by us.
2. Account Registration and Security
a. Account Creation
To use certain features of the App, you must create an account and provide certain personal information, including but not limited to your name, email address, and housing preferences. You agree to provide accurate and complete information and to update your information as necessary.
b. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. If you suspect any unauthorized use of your account, please notify us immediately. We are not liable for any loss or damage resulting from unauthorized access to your account.
3. Paid Features and Subscriptions
Homi offers paid features and subscriptions to enhance your experience. You agree to pay all fees and applicable taxes associated with your use of any paid services.
a. Payment Terms
When purchasing any paid feature, you will be required to provide valid payment information. You authorize us to charge your selected payment method for the total amount of the transaction. All fees are non-refundable unless otherwise specified by applicable law or these Terms.
b. Subscriptions and Auto-Renewal
If you sign up for a subscription, it will automatically renew at the end of the subscription period unless you cancel it through your account settings prior to renewal. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, but cancellation will take effect at the end of the current billing cycle.
4. Using the Homi Services
a. Roommate Matching and Housing Marketplace
Our Services include technology to match you with potential roommates based on your preferences, as well as a marketplace where users can offer or search for housing. You are solely responsible for the interactions and agreements you make with other users, and Homi does not endorse, verify, or guarantee the suitability or safety of any roommate or housing arrangement.
b. Third-Party Realtors
In some cases, we may allow third-party realtors to offer assistance with finding housing. Any engagement with a third-party realtor is at your own risk, and Homi is not responsible for the actions, omissions, or services provided by these third-party professionals.
5. User Conduct
By using the App and Services, you agree to the following:
a. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Impersonating any person or entity or falsely stating or otherwise misrepresenting yourself.
- Harassing, threatening, or intimidating other users.
- Posting, uploading, or transmitting any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
- Using the App or Services for any illegal or unauthorized purpose, including, but not limited to, fraud, spamming, or unauthorized scraping of data.
- Reverse engineering, decompiling, or otherwise attempting to obtain the source code of the App or Services.
b. Content Standards
You agree that all content you post, upload, or transmit through the App will:
- Be accurate and truthful to the best of your knowledge
- Not violate any applicable laws or regulations
- Not infringe on the rights of others
- Be appropriate and respectful
c. Your Sole Responsibility for Due Diligence
YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR:
- Conducting your own background checks, reference checks, and investigations
- Meeting potential roommates in person in safe, public locations
- Verifying all information provided by other users independently
- Making your own determinations about roommate compatibility and safety
- Taking all precautions necessary to protect your personal safety and property
- Conducting thorough screenings before entering into any living arrangements
6. Limitation of Liability
EXCLUSION OF DAMAGES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOMI BE LIABLE FOR ANY personal injury, death, assault, harassment, theft, or other harm resulting from interactions with users.
Homi's total aggregate liability to you for all claims of any kind shall not exceed the lesser of: (a) $100, or (b) the total amount you have paid to Homi in the six months preceding the claim.
7. Indemnification
YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Homi and its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, demands, lawsuits, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services or interactions with other users.
8. Assumption of Risk
BY USING THE SERVICES, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:
- Interacting with strangers through any online platform involves significant inherent risks to your personal safety, security, and property.
- You voluntarily assume all risks associated with using the Services, including but not limited to the risk of meeting, communicating with, or living with other users.
- No online matching service can eliminate the risks inherent in meeting strangers or guarantee the character, intentions, or behavior of users.
- You are solely responsible for your personal safety and security when using the Services or interacting with other users.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App and Services shall be resolved through binding arbitration in Boston, Massachusetts, in accordance with the rules of the American Arbitration Association.
10. Modifications to the Terms
We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms on the App or through other means of communication. Your continued use of the App and Services after any changes constitutes your acceptance of the revised Terms.
11. Termination
You may terminate your account at any time by following the instructions in your account settings. We reserve the right to suspend or terminate your access to the App or Services at any time, for any reason, without notice. Upon termination, all licenses and other rights granted to you under these Terms will immediately cease.
